1. INTRODUCTION
Welcome to Positiva Puppy Yoga. By booking and attending a session, you agree to comply with these Terms and Conditions. These terms outline your responsibilities, our liability limitations, disclaimers, and important rules to ensure a safe and enjoyable experience for all attendees.
Your participation in Positiva Puppy Yoga is voluntary and at your own risk. If you do not agree to these Terms and Conditions, you must not proceed with booking or attending any session.
By purchasing at Positiva “I agree to the Terms and Conditions” at the time of booking, you legally acknowledge and accept all conditions outlined below.
2. PARTICIPATION REQUIREMENTS
2.1. Health and Physical Readiness
• By booking a session, you confirm that you are physically capable of participating in yoga activities.
• You acknowledge that yoga involves stretching, movement, and physical exertion, which may pose risks of strain, discomfort, or injury.
• If you have pre-existing medical conditions, injuries, or are pregnant, you must consult a doctor before participating.
• You assume full responsibility for your own physical well-being and any injuries that may occur during the session.
2.2. Age Restrictions
• Participants must be 18 years or older to attend without supervision.
• Minors (under 18) may only attend if accompanied by a parent or legal guardian, who accepts full responsibility for the minor’s safety and conduct.
2.3. Hygiene & Allergies
• If you have pet allergies, asthma, or any health condition that may be triggered by animals, you are fully responsible for managing your condition.
• If you choose to participate despite an allergy risk, Positive Puppy Yoga assumes no liability for any reaction or health complications.
• All participants must practice proper hygiene before and after interacting with puppies.
3. LIABILITY WAIVER & DISCLAIMER
3.1. Assumption of Risk
By attending a Positiva Puppy Yoga session, you understand and accept that:
Yoga involves physical exertion, which may result in minor or serious injuries (e.g., muscle strains, falls, sprains).
Puppies are unpredictable animals, and interaction with them carries risks such as scratches, bites or allergic reactions.
Positiva Puppy Yoga is not liable for any accidents or injuries that may occur during a session. Each participant is responsible for their own safety and actions.
We are not responsible for any allergic reactions or other health complications that may occur during or after the session. It is your responsibility to take necessary precautions and consult a medical professional if you have concerns.
You voluntarily assume all risks associated with participating in Positiva Puppy Yoga.
3.2. Release of Liability
• Positiva Puppy Yoga, its owners, instructors, employees, contractors, affiliates, and venue providers are not liable for:
• Any injury, illness, or allergic reaction arising from participation.
• Any injury resulting from yoga movements, stretching, or poses.
• Any injuries caused by interaction with puppies, including but not limited to bites, scratches, or allergic reactions.
• Any property damage or loss that occurs before, during, or after the session.
• Any incidents caused by another participant’s actions.
• By participating, you expressly waive any right to sue Positiva Puppy Yoga or make any claims for damages, compensation, or medical costs arising from your participation.
4. RULES FOR INTERACTING WITH PUPPIES
4.1. Responsible Animal Interaction
• Participants must handle puppies gently and respectfully at all times.
• If a participant mistreats, frightens, or causes distress to a puppy, they will be immediately removed from the session without a refund.
• If a participant fails to follow instructor guidance regarding animal interaction, Positive Puppy Yoga is not responsible for any resulting injuries or incidents.
4.2. Supervision & Removal of Animals
• Puppies will be monitored by their handlers, but Positiva Puppy Yoga is not responsible for their behavior.
• If a puppy exhibits distress or aggression, it may be removed from the session.
5. BOOKINGS, CANCELLATIONS, AND REFUNDS
5.1. Bookings
• All bookings must be completed online via our website.
• A booking is only confirmed once full payment has been received.
• Bookings are non-transferable and cannot be resold or exchanged.
5.2. Cancellations & Refunds
• No refunds will be issued for cancellations made less than 48 hours before the session.
In case of cancellation by the participant, no refunds will be provided. However, if the cancellation is made at least 48 hours in advance, a gift card equivalent to the booking amount will be issued, valid for future use.
• Gift cards are non-refundable and cannot be exchanged for cash.
• Participants may request to reschedule their session, subject to availability. If rescheduling without having purchased session protection (insurance), a $20 rescheduling fee will apply.
• If a session is canceled by Positiva Puppy Yoga due to unforeseen circumstances (e.g., venue issues, weather, insufficient bookings, illness),automatically rebooked for a future session or issued a credit note. No refunds will be issued.
• If a participant cancels a scheduled event (team building, birthday, bacherolette...) without a valid reason (medical emergency or force majeure), Positiva Puppy Yoga reserves the right to retain 20% of the total payment as an administrative and organisational fee.
• No-shows will not be refunded, as they represent a lost booking opportunity that could have been offered to someone else.
5.3. Puppy Breeds Disclaimer
• While we strive to provide a variety of puppies for each session, Positiva Puppy Yoga cannot guarantee specific dog breeds.
• Puppy availability depends on several factors, including breeder schedules, litter availability, age suitability, and the puppies’ adoption into their forever homes.
• If a planned breed is unavailable, puppies may be substituted with others to ensure the session can still take place.
• No refunds will be issued due to changes in puppy breeds, as all sessions will still include adorable, well-cared-for puppies.
6. VENUE AND LIABILITY DISCLAIMERS
6.1. Venue Rules
• Participants must follow all venue rules and policies.
• No outside food or beverages are permitted in the yoga area (except water).
• Participants must arrive on time. Late arrivals may not be permitted to join.
6.2. Photography & Social Media
• Positive Puppy Yoga may take photos and videos during sessions for promotional purposes.
• By booking a session, you grant us permission to use your image in marketing materials, unless you request otherwise in writing.
• Personal photography is allowed, but must not disrupt the session or other attendees.
7. INDEMNIFICATION
By participating, you agree to indemnify and hold harmless Positiva Puppy Yoga, its owners, employees, contractors, and affiliates against:
• Any claims, legal fees, or damages resulting from your actions during a session.
• Any claims arising from your failure to disclose allergies, medical conditions, or physical limitations.
• Any claims related to injuries caused by interaction with animals.
8. FORCE MAJEURE
Positiva Puppy Yoga is not responsible for cancellations, delays, or service interruptions caused by:
• Natural disasters (e.g., earthquakes, floods, fires)
• Government restrictions, health mandates, or legal orders
• Technical failures or unexpected venue closures
9. NON-COMPETITION & NON-SOLICITATION
• By participating in a Positiva Puppy Yoga session, you agree not to copy, reproduce, or exploit our concept, brand, or know-how for commercial purposes without our prior written consent.
• You are strictly prohibited from using our methods, branding, or business model to create, promote, or operate a competing Puppy Yoga service for a period of 12 months following your participation.
• You agree not to solicit, hire, or collaborate directly with our employees, instructors, partners, or service
10. AMENDMENTS TO TERMS & CONDITIONS
• Positiva Puppy Yoga reserves the right to update or modify these Terms and Conditions at any time.
• Continued participation in sessions constitutes acceptance of the updated terms.
11. GOVERNING LAW & JURISDICTION
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any legal disputes must be resolved in the courts of Sydney, New South Wales.
12. AGREEMENT TO TERMS & CONDITIONS
By completing your booking, you confirm that:
You have read, understood, and agreed to these Terms and Conditions.
You accept all risks associated with yoga and animal interaction.
You waive any legal claims against Positiva Puppy Yoga for injuries, allergies, or property damage.
You cannot book a session unless you agree to these terms.
